Court: Surety not liable for "consequential damages"


Attorney Brandon Brauer discusses a recent case where the United States District Court for the District of Delaware ruled that Hartford Fire Insurance was not liable for "consequential damages" under a principle of common law. In the case, both the owner and contractor had waived rights to consequential damages in the contract upon which the performance bond was based.
