  • Feds to let states decide on agents' role in exchanges
    The Center for Consumer Information and Insurance Oversight, part of HHS, has released guidance that addresses the role of agents, brokers and navigators in health insurance exchanges. The role played by producers, including whether they allow agents and brokers to work with exchanges and serve as navigators, will largely be up to states. However, agents and brokers acting as exchange navigators "cannot be compensated for enrolling individuals into either [qualified health plans] or other non-QHP health insurance or health plans," according to the guidance.     Commenting on draft Affordable Care Act rules, AHIP executives Daniel Durham and Gregory Gierer have urged HHS to prioritize flexibility. Discussing broker compensation rules, the AHIP officials pointed out that brokers may end up playing different roles inside exchanges compared with outside. "We support a level playing field between the inside exchange market and the outside market including approaches to broker compensation that do not have the intent of favoring either the exchange or the outside market," they wrote. "Therefore, any requirements related to broker compensation need to allow for flexibility to adapt to these considerations, and accommodate the fixed costs already being required."
